Terms of use for The Hunting Ensemble

Agreement to Terms of Use
These Terms and Conditions of Use (the ‘Terms of Use’) apply to the website located at www.thehuntingensemble.nl. The site is the property of The Hunting Ensemble by using the site, you agree to these terms of use if you do not agree, don’t use the site.

The Hunting Ensemble reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the site following the posting of changes will mean that you accept and agree to the changes.

As long as you comply with these Terms of Use, The Hunting Ensemble grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the site.

Content
All text, graphics, user interfaces, visual interfaces, photographs (except the blog pictures), trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, ‘look and feel’ and arrangement of such content, contained on the site is owned, controlled or licensed by or to The Hunting Ensemble, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.

Except as expressly provided in these Terms of Use, no part of the site and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise.

Shipping & Delivery
We do our utmost best to ship your package as soon as possible. For transit times please click here.
If the order is not delivered within 30 days from the date The Hunting Ensemble received the payment, the consumer is entitled to cancel the order (pre-orders excluded).

The Hunting Ensemble is obliged to refund the payment within 10 days. Products are shipped directly from The Netherlands. If a package is returned to The Netherlands because the buyer did not claim the package, the Hunting Ensemble does not send replacements.

The Hunting Ensemble is not responsible for any actions taken by customs on your package during delivery, we’ve no control over this. Buyer is responsible for any customs charges that may be applied to your package. Customs determines these charges, and the Hunting Ensemble has no way of knowing what these charges may be.

Return, exchange and refund policy
If you are not satisfied with your purchase you can send it back within 14 days after reception of the good(s). Please note: return costs are for own account. Products must be returned in unworn, unwashed and undamaged condition in the same packaging as received. Please fill in the return form that was enclosed and return the package as soon as possible. You can return the product to the following address:

Note: returned items that do not meet the return policy may be refused by The Hunting Ensemble and returned to the customer. The shipping costs are for the account of the customer.

IMPORTANT: IF you are sending back goods from outside the EU, mark them as RETURNED GOODS with 0 USD/EUR CUSTOMS VALUE. Otherwise we are charged for the return and cannot accept it.

After receiving the returned product(s), you’ll get an e-mail that we received your returned item. We will refund the purchase amount of the returned product(s) to your bank account within 30 days. If your purchased product is not worn or damaged you will always get your money back!

When upon arrival your product shows factory defects or if we shipped the wrong colour, size or any other fault on our behalf we will pay for the return transport costs or credit for the made shipping cost to your bank account within 10 days. In all other cases, you will have to pay for the transport costs of the returned good(s), unless agreed otherwise.

In case of an exchange and the desired product is not available you will receive a credit memo which has to be redeemed within 3 months. If you choose to use an untrackable shipping method, we cannot be held responsible for packages lost in the transport. Cancellations
If you would like to cancel your order, please contact our customer service within 24 hours after purchase. We will assess your request for cancellation and try our best to cancel your order in time. Unfortunately, this is not always possible.

Defects and guarantee
If for some reason your product is broken or does not meet the quality you would expect please send us an e-mail through the contact form or [email protected] on the purchase date, cause and seriousness of the defect we will determine if you get a new product, full refund or store credit. We will process your claim as soon as possible. We always reply within 24 hours and keep you updated during the process. If your claim is accepted we will send you a replacement/refund or store credit on the same day. We will refund your return costs if defect or broken product(s) need to be returned to us.

Retourneren, ruilen en refund beleid
Indien je niet tevreden bent met het product dat je hebt ontvangen dan kun je het terugsturen binnen 14 dagen na ontvangst. Let op: retourkosten zijn voor eigen rekening tenzij anders overeengekomen. Producten die worden geretourneerd moeten ongedragen, ongewassen en onbeschadigd zijn. Daarnaast dient het product te worden terug gezonden in de fabrieksverpakking. Indien je een product wilt retourneren vul je het retourfomulier in dat meegeleverd is bij je bestelling. Stuur je pakketje zo snel mogelijk terug naar onderstaand adres:

Let op: Geretourneerde items die niet voldoen aan de retourvoorwaarden mogen geweigerd worden door The Hunting Ensemble en worden teruggestuurd naar de klant. De kosten hiervan zijn voor rekening van de klant

Na ontvangst van je geretourneerde product sturen we je een e-mail dat we je retour hebben ontvangen. We storten het aankoopbedrag terug binnen 10 dagen op je bankrekeningnummer. Indien een product niet is gedragen of is beschadigd krijg je altijd je geld terug!

Als je van ons een defect product, de verkeerde maat of kleur hebt ontvangen of we een andere fout hebben gemaakt dan betalen wij de retourneer kosten. Indien je deze kosten zelf al hebt gemaakt dan vergoeden we deze kosten door het bedrag voor de verzendkosten binnen 10 dagen over te maken naar je bankrekening. In alle andere gevallen moet je zelf betalen voor de retourneerkosten tenzij anders is overeengekomen. Als je besluit om gebruik te maken van een verzendmethode waarbij pakketten niet traceerbaar zijn, dan kunnen wij niet verantwoordelijk worden gehouden voor het mogelijke zoekraken van je pakket.

Indien je een product wilt ruilen voor een andere kleur, maat of item en het product is niet op voorraad dan krijg je een tegoedbon welke je dient te gebruiken binnen drie maanden na ontvangst. Voor overige vragen omtrent het ruilen en retourneren van producten kun je ons mailen via: [email protected] We proberen binnen een paar uur te reageren op je mail. Je hebt uiterlijk binnen 24 uur antwoord op je vraag.

Defecten en garantie
Als je product defect is of het niet aan de kwaliteit voldoet die je ervan mag verwachten, stuur ons dan een e-mail via het contact formulier of door te mailen naar [email protected] Aan de hand van de aankoopdatum, reden van defect en de ernst bepalen we of je een nieuw product of geld terug krijgt. Een tegoedbon behoort ook tot de mogelijkheden. We behandelen je garantie claim zo snel mogelijk. We reageren altijd binnen een paar uur en uiterlijk binnen 24 uur na ontvangst van je mail. Indien je garantie claim wordt geaccepteerd door ons dan sturen we je dezelfde dag een nieuw product op. Als we besluiten je geld terug te storten gebeurt dit eveneens dezelfde dag. Indien een defect product moet worden terug gestuurd naar ons dan vergoeden we de verzendkosten.

Мы оплатим стоимость пересылки, либо перечислим соответствующую сумму на Ваш банковский счет в течение 10 дней в случае, если возвращенный товар имеет признаки заводского брака или если мы отправили неправильный цвет, размер, либо совершили какую-либо другую ошибку. В остальных случаях, Вы оплачиваете стоимость доставки возвращаемого товара (товаров), если не было иных договоренностей.

Если в случае обмена желаемого товара нет в наличии, Вы получите кредитовое авизо, которое можно использовать в течение 3 месяцев. Если Вы воспользуетесь услугами пересылки без номера отслеживания, мы не несем ответственности за посылки, утерянные при транспортировке. Мы обработаем Вашу претензию как можно быстрее. Мы всегда отвечаем в течение 24 часов и информируем Вас о ходе процесса. Если Ваша претензия принята, мы отправим замену/возмещение или оформим возврат стоимости покупки на Ваш аккаунт в магазине в тот же день. Мы возместим стоимость пересылки, если бракованный или испорченный товар (товары) должен быть возвращен нам.

返品＆交換：

返却された商品が弊社に届きましたら、お客様宛てに確認のメールが届きます。1０日以内にあなたの銀行口座に返品された商品の価格と同じ金額が振り込まれます。つまり、購入後に返品いただいた商品が未着用かつ傷みが見られなかった場合は、どのような場合であっても返金されるということです！

ご自宅に届いた商品に製造段階で付いたと思われる傷やほつれが見られたり、注文時と異なるカラーやサイズの商品が届くなど、生じた問題が当社の責任によるものである場合、返送料を当社が負担します。当社の責任が認められた場合、1０日以内にお客様の銀行口座に送料と同じ金額が振り込まれます。上記いずれのケースにも当てはまらない場合の送料はお客様のご負担となります。

商品の交換の際に、ご希望の商品の在庫が無かった場合、３ヶ月以内に払い戻しが行われるクレジットメモが発行されます。商品の返送時にお客様が追跡機能の無い郵送サービスを選んで紛失等のトラブルが起こった場合、当社は一切の責任を負いかねます。商品返却・交換・払い戻しなどへのさらなる質問がございましたら、いつでもお気軽に [email protected] までご連絡下さい。２４時間以内に返信いたします。

商品に欠陥があった＆間違った商品が届いた
ここでは商品の欠陥や、欠陥のある商品の返品プロセスについて説明します。

商品の欠陥と保証について：
なんらかの理由によって、商品に破損・汚損などの欠陥があったり、お客様の期待した品質に達していなかった場合、コンタクトフォームもしくは [email protected] までメールでお知らせ下さい。購入日や欠陥の原因と深刻さのレベルに応じて、新しい商品と交換する、全額返金する、購入された金額と同じ金額の当店での買い物の権利を付与するのいずれかに対応を決定させていただきます。お客様の要望には速やかに対応します。２４時間以内に返信し、プロセスを逐一お伝えいたします。もしお客様の要求が認められた場合、交換や返金、もしくは購入された金額と同じ金額の当店での買い物の権利を付与させていただくなどして対応させていただきます。工場出荷時に欠陥のあった商品に関しては返送時の郵送代金も当社が負担します。

Payment
Payments are done save and secure by using certified payment systems such as; Direct Bank transfer, credit card, iDeal and PayPal. iDeal can only be used by Dutch customers. Customers from outside The Netherlands can pay with PayPal by using there PayPal-account or can use credit card payment as a payment option.

Accounts, Passwords and Security
Certain features or services offered on or through the site may require you to open an account. You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. You agree to notify the Hunting Ensemble
immediately of any unauthorized use of your account or password, or any other breach of security. However, you may be held liable for losses incurred by the Hunting Ensemble or any other user of or visitor to the site due to someone else using your password or account.

You may not use anyone else’s password or account at any time without the express permission and consent of the holder of that password or account. the Hunting Ensemble cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations. The Hunting Ensemble has implemented all necessary security measures to provide a secure shopping experience.

Indemnity
You agree to indemnify and hold the Hunting Ensemble, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against The Hunting Ensemble by any third party due to or arising out of or in connection with your use of the site.

Violation of These Terms of Use
The Hunting Ensemble may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary for connection with any investigation or complaint regarding your use of the site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with(either intentionally or unintentionally) The Hunting Ensemble’s rights or property, or the rights or property of visitors to or users of the site, including The Hunting Ensemble’s customers.

You acknowledge and agree that The Hunting Ensemble may preserve any transmittal or communication by you with The Hunting Ensemble through the site or any service offered on or through the site, and may also disclose such data if required to do so by law or The Hunting Ensemble determines that such preservation or disclosure is reasonably necessary to;
(1) comply with legal process,
(2) enforce these Terms of Use,

(4) protect the rights, property or personal safety of The Hunting Ensemble, its employees, users of or visitors to the site, and the public.

You agree that the Hunting Ensemble may, in its sole discretion and without prior notice, terminate your access to the site and/or block your future access to the site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to The Hunting Ensemble, for which monetary damages would be inadequate, and you consent to The Hunting Ensemble obtaining any injunctive or equitable relief that The Hunting Ensemble deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies The Hunting Ensemble may have at law or in equity.

You agree that the Hunting Ensemble may, in its sole discretion and without prior notice, terminate your access to the site, for cause, which includes (but is not limited to):
(1) requests by law enforcement or other government agencies,
(2) a request by you (self-initiated account deletions),
(3) discontinuance or material modification of the site or any service offered on or through the site, or
(4) unexpected technical issues or problems.

If the Hunting Ensemble does take any legal action against you as a result of your violation of these Terms of Use, The Hunting Ensemble will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to the Hunting Ensemble. You agree that the
Hunting Ensemble will not be liable to you or to any third party for termination of your access to the site as a result of any violation of these Terms of Use.

Governing Law Dispute Resolution
You agree that all matters relating to your access to or use of the site, including all disputes, will be governed by the laws of The Netherlands. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received
for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees.

In the event of any controversy or dispute between the Hunting Ensemble and you arising out of or in connection with your use of the site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If
we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

Void Where Prohibited
The Hunting Ensemble administers and operates the www.thehuntingensemble.com (and all linked domains) from its location in Nijmegen, The Netherlands. Although the site is accessible worldwide, not all features, products or services discussed, referenced, provided or offered through or on the site are available to all persons or in all
geographic locations.

The Hunting Ensemble reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product or service to any person or geographic area. Any offer for any feature, product or service made on the site is void where prohibited.
